Terms of Service
Last updated October 19, 2026
Please read these terms carefully. Section 27 requires most disputes to be resolved by individual binding arbitration and waives class actions and jury trials, unless you opt out within 30 days as described there.
1. Agreement to these terms
These Terms of Service (the "Terms") are a contract between you and The Incubator LLC, a New Jersey limited liability company doing business as BuildPartner.ai ("BuildPartner.ai", "we", "us"). They govern your use of the buildpartner.ai website and dashboard, the BuildPartner.ai Claude Code plugins, the buildpartner npm package and MCP server, our install scripts, our coaching, calls, programs, builds and content, and any related services (together, the "Service").
By creating an account, running our install script, installing our plugin, making a purchase, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of a company or other organization, you agree to these Terms for that organization and confirm you have authority to do so. In that case "you" means the organization. A separate written order or agreement signed by both parties controls over these Terms where they conflict.
2. Who can use BuildPartner.ai
You must be at least 18 years old and able to form a binding contract. You may not use the Service if you are barred from doing so under the laws of the United States or your country, or if we have previously terminated your account.
3. Your account and access token
- Give us accurate information and keep your email address current. We use it to sign you in and to send you notices about your account.
- When you sign up we issue an access token that lets the plugin and command line tools act as you. Treat it like a password. Do not share it, post it, or commit it to a public repository. You can rotate it from your dashboard, and we may rotate or revoke it if we believe it is exposed.
- You are responsible for all activity under your account and token. Tell us right away at support@buildpartner.ai if you think someone else has access.
- Accounts are for one person. Do not share a login or token with others or let several people use one paid seat.
- One free account per person. Creating extra accounts to get more free credits, promotions, or trials is not allowed, and we may close those accounts and remove the credits.
- We may apply rate limits and usage caps to keep the Service working for everyone.
4. What we provide
BuildPartner.ai helps people get more out of Claude Code. Depending on your plan, the Service may include skills and tools that run inside Claude Code, expert frameworks, step-by-step builds, social media research tools, a system review and improvement loop, a Command Center, a member dashboard and community, human coaching by chat, live calls, and structured programs. What each plan includes is described on our pricing and program pages at the time you buy.
We may add, change, limit or remove features at any time, including the expert frameworks, builds, tools and integrations available. We do not promise that any particular feature, content, coach, or schedule will stay available. If we discontinue the Service entirely, or stop offering a paid plan you are on without moving you to a plan with comparable features, we will refund the unused part of any fees you prepaid for that plan.
5. Claude Code and Anthropic
- BuildPartner.ai is an independent product. We are not affiliated with, endorsed by, or sponsored by Anthropic. Claude and Claude Code are products and trademarks of Anthropic, PBC.
- Most of the Service works through Claude Code. You need your own Claude Code access and must follow Anthropic's terms and usage policies. Anything you type into Claude Code, and the responses it generates, are processed by Anthropic under your agreement with Anthropic, not under these Terms.
- We do not control Claude Code, Anthropic's models, their availability, their pricing, or their usage limits. Changes Anthropic makes may change how the Service works or stop parts of it from working.
- Using the Service consumes your own Claude Code usage and limits. Our hooks, automatic updates, scheduled routines and skills run inside your Claude Code account. We are not responsible for Anthropic's charges, rate limits, or any action Anthropic takes on your account.
6. Software on your computer
By installing the BuildPartner.ai plugin or running our install script, you understand and agree that:
- The install script may install Claude Code if it is missing, add a line to your shell profile, store your sign-in details in a
~/.buildpartnerfolder, add a clearly marked BuildPartner.ai section to your~/.claude/CLAUDE.mdfile, and install our plugins from our public marketplace. - The plugin installs hooks that run when Claude Code starts and ends a session. They keep the CLAUDE.md section current, record basic usage events (for example which BuildPartner.ai tool ran and when), and send those events to us as described in our Privacy Policy.
- The plugin updates itself automatically, checking about once an hour. You consent to these automatic updates. Updates may add, change or remove features.
- The plugin pre-approves Claude Code permission prompts for BuildPartner.ai's own tools so you are not asked every time they run. It does not pre-approve other tools.
- Some skills read files on your computer, such as your Claude Code settings, CLAUDE.md files, skills, session history and git history, to give you recommendations. Unless a skill tells you otherwise, that reading happens on your machine. Some skills can edit your files or create new skills, and routines you schedule can run without you watching. You are responsible for reviewing changes made on your computer and for keeping backups. The Service is not a backup or storage service for your code or files.
- You can uninstall at any time with our uninstall script or by removing the plugin in Claude Code. Some plugin source files are published under their own open source license (such as MIT). That license governs those files. These Terms govern your access to the Service.
7. AI output and no professional advice
- The Service uses AI, including Claude, to produce answers, recommendations, code, summaries and other output. AI output can be wrong, incomplete, out of date, or unsuitable for your situation. You are responsible for reviewing it before you rely on it, run it, publish it, or ship it.
- AI output is not unique. Output generated for you may be the same as or similar to output generated for other users, and you get no exclusive rights in it.
- You are responsible for code, automations and agents you build or run with the Service, including their security, testing, compliance with law and with third-party terms, and their effect on your systems, data, customers and accounts.
- Content in the Service, including content about business, pricing, sales, marketing, money, health, fitness and mindset, is general educational information. It is not legal, financial, investment, tax, medical, psychological or other professional advice, and no professional relationship is created. Talk to a qualified professional before making decisions in those areas.
- Examples, case studies, success stories and statements about time saved or results are illustrations, not promises. Your results depend on many things we do not control, including your own effort.
8. No guarantee of results
We make no promise that you will save any amount of time, earn any amount of money, grow your business, get a job, ship a product, or achieve any other outcome by using the Service, taking a program, or following coaching. Figures such as hours saved and the stories, testimonials and case studies we share are the experiences of specific people. They are not a promise or prediction of what you will achieve, and you should not expect the same results. Your results depend on your skills, effort, business, market, and many factors outside our control. Any decision you make based on the Service is yours.
9. Expert frameworks
Our expert frameworks are our own summaries and paraphrases of ideas that well-known people have shared publicly, with references where we have them. They are not quotes and are not written, reviewed, endorsed or sponsored by those people, and those people are not affiliated with BuildPartner.ai. Names are used only to identify the source of the ideas. Names, images and trademarks belong to their owners.
10. Plans, credits and billing
Free use and credits
Free accounts receive a limited number of credits. Different tools use different amounts of credit, as shown in the product. Credits have no cash value, cannot be transferred or sold, and may expire or change. We may offer free or promotional access on terms we state at the time.
Subscriptions
- Paid plans are subscriptions that renew automatically at the end of each billing period (monthly or yearly, as you choose) at the then-current price until you cancel. By subscribing, you authorize us and our payment processor to charge your payment method at the start of each period.
- Payments are processed by third parties, currently Stripe and Whop. Their terms also apply to your payment, and purchases made through Whop also follow Whop's checkout, receipt and refund process. We do not store your full card number.
- Upgrades take effect right away and are prorated where your payment provider supports it. Downgrades follow the terms shown when you make the change.
- For yearly plans, we email you before the renewal charge.
- If you are on a legacy or grandfathered price, it continues only while that subscription stays active and unchanged. Cancelling, lapsing, or changing plans ends it, and the then-current price applies to any new plan.
- Prices do not include taxes unless stated. You are responsible for applicable taxes, which may be added at checkout.
- We may change prices. For existing subscriptions, we will give you at least 30 days' notice by email, and the new price will apply from your next renewal after that notice. You can cancel before then.
- If a payment fails, we may retry it and may pause or downgrade your access until it succeeds.
Promotions, discounts and test pricing
Discount codes, free months, trials and other offers are subject to the terms stated with them, are limited to one per person unless stated otherwise, and may be changed or ended at any time for new redemptions. Promotional access that does not ask for a payment method ends on its stated date and does not convert into a paid plan on its own. Prices labeled as tests, or reached by altering requests to our systems, are for our internal testing only. Plans bought at those prices are not valid. We may cancel them and refund what you paid, and no access or services are owed for them.
One-time programs and payment plans
Some programs, such as the Executive AI Program, are sold for a one-time fee, which you may be allowed to pay in installments. A payment plan is not a subscription: it is a fixed number of payments toward a fixed total, with no interest, and the total and schedule are shown before you buy. The total on a payment plan may be higher than the pay-in-full price. If you choose a payment plan, you authorize each scheduled charge and you owe the full plan total even if you stop participating, except as allowed in Section 11. If an installment fails and is not paid within 14 days of our notice, we may suspend your program access until it is paid and the remaining balance becomes due. Program seats are personal and cannot be transferred to someone else. The Executive AI Program term is the program schedule shown when you buy, plus the included months of Collaboration access.
11. Cancellation and refunds
- You can cancel a subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. You keep access until then and will not be charged again. We may show you one offer to stay, which you can decline in one step. This applies to subscriptions, not to installment payment plans for one-time programs.
- Except as stated in these Terms, on the page where you bought, or where required by law, subscription fees are non-refundable and we do not give refunds or credits for partial periods or unused credits. Where the product says a change (for example a downgrade) refunds or credits unused time, we honor what it says.
- Executive AI Program: if you ask for a refund within 7 days of your purchase, we will refund what you paid in full. After 7 days, program fees and remaining installments are non-refundable. A deposit described as refundable will be refunded on request at any time before you are granted program access or pay the balance, whichever is first; after that, the 7-day window above applies to the whole purchase.
- If you live in the European Union or United Kingdom, you have a right to withdraw from a purchase within 14 days. By starting to use a paid digital service right away, you ask us to begin immediately and acknowledge that you lose that right once the service has been fully provided, and that if you withdraw earlier you may owe a proportionate amount for what was provided.
- Ask for a refund at support@buildpartner.ai. If you file a chargeback instead of contacting us, we may suspend your account while it is resolved.
12. Coaching, calls and programs
- Coaching is provided by people on our team in chat and on calls. "Unlimited" coaching means no fixed cap on messages for normal individual use. It is not round-the-clock support, response times vary, and we may limit use that is excessive, automated, or for people outside your account.
- Coaches give guidance. They do not access or control your accounts or systems unless you choose to give them access, and you remain responsible for decisions you make and work you ship. Coaches are not licensed therapists, financial advisors, or lawyers, and coaching is not a substitute for professional services.
- Where a program or plan names a specific person (for example a call with Austin), we may substitute another qualified member of our team if that person is unavailable, and we may change coaches at any time.
- Messages, files and recordings you send in coaching are visible to our coaching team. Do not send passwords, API keys, payment details, health information, or other people's confidential information.
- Group calls and office hours may be recorded and shared with other members. We will say so at the start of a recorded call, and by staying on the call you consent to being recorded. If you do not want to appear in a recording, keep your camera and microphone off and ask questions in chat. One-on-one calls are not shared with other members.
- The only guarantee on a program is the refund promise stated in Section 11 and on the page where you bought. Programs do not guarantee that you will finish a build, ship an app, or achieve any business or financial result, and we do not build, host, or maintain the work for you.
- Live sessions, schedules, coaches and program content may change, and missed sessions are not refunded or credited. Physical items (such as merchandise) are gifts, ship only where we can ship, and arrive on a best-effort basis. You are responsible for any customs duties or import taxes.
- Program materials, recordings and lessons are for your personal use as a member. Do not share, record, redistribute or resell them.
- When an included access period (for example the months of Collaboration included with a program) ends, paid access continues only if you choose a plan. We will not start charging you for a subscription you did not authorize.
13. Team and organization plans
- Team plans are set up for an organization under an order or agreement with us, and the organization is responsible for its members' use.
- The organization keeps ownership of the knowledge, documents and other material it gives us to power its team skills ("Organization Content"). It grants us a license to host, process and serve that content to its members to provide the Service, and confirms it has the rights to share it.
- Organization Content is available to every member of that organization. Organization leaders can see usage information for their members, such as how often each member uses the Service.
- The organization's leaders may add and remove members and direct us about the organization's account, and we may rely on their instructions. Leaders can see usage information for their members and the topics members ask the team about.
- Organization plans may be subject to a data processing addendum we provide, which controls over this section for personal data.
- When a member leaves an organization or the organization's plan ends, that member loses access to Organization Content.
14. Community and conduct
- Member spaces include our forum, group calls and office hours, private Slack channels, the talent directory, and any other place where members interact. Be respectful. No harassment, hate, spam, unsolicited selling, recruiting members to competing products, or sharing other members' private information.
- Treat what other members share in those spaces as confidential. Do not record, screenshot, or repost it outside the community without their permission.
- We may moderate, edit, hide, or remove any post or recording, and may remove anyone from a space, at our discretion and without notice. We are not obligated to monitor member spaces or store posts.
- If you opt in to the talent directory, the details you submit are shown to other members, including businesses looking to hire, so they can contact you. We do not vet members, employers, or opportunities. Your dealings with other members, including any hiring, partnership, or business arrangement, are solely between you and them, and you release us from claims arising out of them. If you live in California, you waive California Civil Code Section 1542 for this release, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
15. Your content
- You own what you build. As between you and us, you own the code, agents, skills, documents and other work you create with the Service, and the content you submit to us ("Your Content"), subject to any rights others have in it.
- You grant us a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit and display Your Content only as needed to provide, secure and support the Service and as described in our Privacy Policy. This license ends when Your Content is deleted from our systems, except for copies we must keep by law or in routine backups.
- Posts you make in member-only spaces, such as the forum, are visible to other members with your name, and may remain, without your name, after you leave. We will only feature you publicly, for example in a success story or testimonial, with your permission. When you agree, you grant us a perpetual, royalty-free license to use your name, likeness, and statements for that purpose. You can ask us to stop future uses at any time.
- You are responsible for Your Content and confirm you have the rights to submit it and that it does not break the law or anyone's rights.
- If you send us ideas, suggestions or feedback, we may use them without restriction or payment to you.
- We may collect and use usage data and statistics about how the Service is used, and create aggregated or de-identified data from it, to run and improve the Service and for our business purposes. We will not identify you from that data.
- Export anything you want to keep before your account closes. We may delete Your Content after your account is closed, and we are not responsible for lost content.
16. Our content and intellectual property
The Service, including our software, skills, frameworks, builds, programs, lessons, videos, designs, and the BuildPartner.ai name and logo, is owned by us or our licensors and protected by intellectual property laws. Subject to these Terms and your plan, we give you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal or internal business purposes.
You may use what you learn and keep the work you build by following our builds and lessons. You may not copy, resell, republish, or redistribute our content itself (for example by reposting builds or frameworks, sharing program materials, or packaging them into a competing product or course) without our written permission.
Plans, recommendations, and other deliverables we prepare for you (for example a custom solution request) are licensed to you for your own use and are not for resale. We keep the right to reuse the general know-how, techniques, and templates behind them for other customers, without using your confidential information.
17. Acceptable use
You agree not to, and not to help anyone else to:
- break any law or anyone's rights, or use the Service to build or run anything illegal, deceptive, or harmful;
- use our social media research tools to harass, stalk, dox, or discriminate against anyone, to build lists of people for spam, or in a way that breaks the terms of the platforms involved;
- share, sell, or resell access to your account, token, credits, or our content;
- get around credits, usage limits, payment, plan restrictions, or other technical limits, including by altering requests to our systems;
- scrape, bulk download, or systematically copy our content, or use it to train, fine-tune or improve an AI model or a competing product;
- reverse engineer our servers or non-public parts of the Service, except where the law allows it despite this limit;
- probe, scan, or test the security of the Service, or upload malware, without our written permission;
- overload, disrupt, or interfere with the Service or other users;
- impersonate anyone, or misrepresent your connection to us, Anthropic, or anyone else; or
- use the Service in a way that breaks Anthropic's usage policies.
If you find a security issue, please report it to support@buildpartner.ai. We will not pursue claims against good-faith research that stays within your own account, avoids other users' data, does not disrupt the Service, and gives us a reasonable time to fix the issue before any disclosure.
18. Copyright complaints
We respect intellectual property. If you believe something on the Service infringes your copyright, send a notice to support@buildpartner.ai with "Copyright" in the subject line that includes: the work you say is infringed, where the material is on the Service, your contact details, a statement that you believe in good faith the use is not authorized, a statement under penalty of perjury that the notice is accurate and you are authorized to act, and your physical or electronic signature. We may remove the material and will tell the person who posted it, who may send a counter-notice with the same elements and consent to the jurisdiction of the federal court for their address (orNew Jersey if outside the United States). We may restore material 10 to 14 business days after a valid counter-notice unless the complainant files a court action. We close the accounts of repeat infringers.
19. Third-party services and links
The Service works with and links to third-party services, such as Anthropic, Stripe, Whop, Google, Calendly, Slack, Deepgram, social media platforms, the providers listed in our Privacy Policy, and tools we recommend. Their terms and privacy policies govern your use of them, and we are not responsible for them. Some links to recommended tools or deals are affiliate links, which means we may earn a commission if you buy, at no extra cost to you.
Our social media research tools return publicly available information from third-party platforms through data providers. That information may be incomplete, out of date, or wrong, and platforms may change or cut off access at any time. You are responsible for how you use it and for complying with the platforms' terms and the law, including privacy and anti-spam laws.
20. Privacy
Our Privacy Policy explains what information we collect, what stays on your computer, and how we use and share information. It is part of these Terms. Our Data & Privacy FAQ explains the same in plain words; if the two ever differ, the Privacy Policy controls.
21. Communications
By giving us your email address or phone number, you agree that we may contact you about your account, purchases, applications, programs, and support, by email, phone, text message, or messaging platforms. Message and data rates may apply. We send marketing text messages only if you separately agree to them, and agreeing is never a condition of buying anything. You can opt out of marketing emails with the unsubscribe link, and of text messages by replying STOP or emailing support@buildpartner.ai. Service messages continue while you have an account.
22. Changes and beta features
Features marked as beta, preview, early access, or similar are provided as-is, may change or be removed at any time, and may be less reliable than the rest of the Service.
23. Suspension and termination
- You can stop using the Service at any time. To delete your account, email support@buildpartner.ai.
- We may close free accounts that have not been used for 12 months, after emailing you first.
- We may suspend or end your access if you break these Terms, if your use creates risk or legal exposure for us or others, if you do not pay, or if we stop offering the Service. Where reasonable, we will tell you first and give you a chance to fix the problem.
- If we end a paid plan for reasons other than your breach, we will refund the unused part of any prepaid fees.
- Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) survive termination.
24. Disclaimers
To the maximum extent permitted by law, the Service and all content and output are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that the Service, any AI output, or any code or automation built with the Service will be accurate, secure, or achieve any result.
We do not offer an uptime guarantee or service credits. The Service depends on Anthropic, our hosting and payment providers, and other third parties, and may be unavailable, slow, or changed because of them.
25. Limitation of liability
To the maximum extent permitted by law, neither we nor our members, employees, coaches, contractors, or licensors will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising out of or relating to these Terms or the Service, even if we were told they were possible.
To the maximum extent permitted by law, our total liability for all claims arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim and (b) one hundred US dollars ($100).
These limits do not apply to liability that cannot be limited by law, such as liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by our negligence.
26. Indemnification
To the extent permitted by law, you will defend and indemnify us and our members, employees, coaches and contractors against third-party claims, and the related losses and reasonable legal fees, arising from Your Content, your use of the Service in breach of these Terms or the law, or anything you build or run with the Service. We will tell you about any such claim and let you control the defense, and you will not settle it in a way that admits fault for us without our consent.
27. Dispute resolution and arbitration
Talk to us first
Most problems can be solved quickly. Before starting any claim, email support@buildpartner.ai with your name, the email on your account, a description of the dispute, and what you want. Both sides will try in good faith to resolve it within 60 days.
Individual arbitration
If we cannot resolve it, you and we agree to resolve any dispute arising out of or relating to these Terms or the Service by final and binding individual arbitration, except as set out below. This means you are giving up your right to bring claims in court and have them decided by a judge or jury. An arbitrator can award the same individual relief a court could, but there is no judge or jury and court review of an award is limited. The Federal Arbitration Act governs this section. Arbitration will be run by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules when you are an individual, and otherwise under its Commercial Arbitration Rules, before a single arbitrator. Hearings may be by video or phone, or in the county where you live, or in New Jersey if you agree. Fees are paid as the AAA rules provide. The arbitrator decides all questions about the scope and enforceability of this section, except that a court decides the class action waiver below.
Exceptions
Either party may bring an individual claim in small claims court if it qualifies, and either party may ask a court to stop infringement or misuse of its intellectual property.
Class action and jury trial waiver
You and we may bring claims only individually, not as a plaintiff or class member in any class, collective, consolidated, or representative action, and you and we waive any right to a jury trial. If 25 or more similar arbitration demands are filed by or with the same counsel, they will be administered in batches under the AAA's mass arbitration procedures. If the class action waiver is found unenforceable for a claim, that claim will go to court and not to arbitration, and the rest of this section still applies.
Time limit on claims
To the extent permitted by law, any claim arising out of or relating to these Terms or the Service must be filed within one year after it arises, or it is permanently barred.
Opting out
You can opt out of this arbitration agreement by emailing support@buildpartner.ai within 30 days of first accepting these Terms, with the subject line "Arbitration opt-out" and the email address on your account. Opting out does not affect any other part of these Terms. If we change this section in a material way, you may reject the change by emailing us within 30 days of the change.
28. Governing law
These Terms are governed by the laws of the State of New Jersey and applicable federal law, without regard to conflict of law rules. For any dispute not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in New Jersey, except that either party may bring a qualifying claim in small claims court where you live. If you are a consumer living outside the United States, you keep any protections the mandatory laws of your country give you.
New Jersey residents: the exclusion of consequential damages, the liability cap, and the one-year claims limit in these Terms do not apply to claims under the New Jersey Consumer Fraud Act, claims for personal injury or property damage, or claims arising from our fraud, gross negligence, or willful misconduct. The indemnification section does not require you to indemnify us for our own negligence. Nothing in these Terms limits any right you have under the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act or other New Jersey law that cannot be waived.
29. Changes to these terms
We may update these Terms. We will post the new version here and change the date at the top. For material changes, we will give you notice by email or in the product at least 14 days before they take effect, unless a change is needed sooner for legal or security reasons. Continuing to use the Service after changes take effect means you accept them. If you do not agree, stop using the Service and cancel any subscription.
30. General
- These Terms, the Privacy Policy, and any terms shown at purchase are the entire agreement between you and us about the Service.
- If any part of these Terms is found unenforceable, it will be enforced to the maximum extent possible and the rest stays in effect.
- Our failure to enforce a provision is not a waiver of it.
- You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets, or to an affiliate.
- Neither party is liable for delays or failures caused by events beyond its reasonable control, including outages of Anthropic or other providers.
- You agree that we may send you notices and agreements electronically, and that they satisfy any requirement that they be in writing.
- You must follow U.S. export control and sanctions laws when using the Service.
- Nothing in these Terms creates a partnership, employment, agency, or fiduciary relationship.
- Headings are for convenience only. "Including" means "including without limitation".
